Terms of Service
Please read these Terms of Service carefully before using the Petsly mobile application and related services. These terms govern your use of our platform and describe the rights and responsibilities of all users. By using Petsly, you agree to be bound by these terms.
1. Acceptance of Terms
Petsly is a trading name of Theodoros Herodotou, a sole trader registered in the Republic of Cyprus under Business Name registration number EE 63545, of Grigori Afxentiou 154, Parekklisia 4520, Limassol, Cyprus. Contact: support@petsly.pet. Full legal details are available at https://petsly.pet/legal. By downloading, accessing, or using the Petsly mobile application, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this application.
2. Platform Description
Petsly is an online marketplace that connects pet owners with independent pet sitters, facilitating bookings, payments, and communication between users. Petsly is NOT a pet care provider. All pet care services are performed exclusively by independent pet sitters who are not employees, agents, or contractors of Petsly. Petsly's role is limited to providing the technology platform that enables users to connect and transact.
3. Marketplace & Intermediary Disclaimer
IMPORTANT: Petsly acts solely as an online marketplace and intermediary platform. Petsly does not provide pet care services and is not responsible for the actions, conduct, or omissions of any pet sitter. Petsly expressly disclaims all liability for: (a) any injury, illness, death, or harm to any pet; (b) any property damage arising from a booking; (c) the quality, safety, or suitability of services provided by pet sitters; (d) the conduct or behaviour of any user on or off the platform. Pet sitters are independent service providers solely responsible for their own services.
4. User Accounts
You must create an account to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it up to date.
5. Booking and Payments
All bookings are subject to availability and confirmation from the pet sitter. Payments are processed securely through Stripe, a licensed payment services provider. Petsly acts as a commercial agent facilitating payments between pet owners and pet sitters on their behalf; Petsly does not itself hold or transmit funds in a manner that constitutes regulated payment services under PSD2 — all payment processing is performed by Stripe. Petsly may collect a platform service fee on each transaction, which is disclosed at checkout. Payments must be made through the platform: All payments for pet care services arranged through Petsly must be made through the platform. Pet owners and pet sitters must not agree, request, offer, or accept payment for such services in cash, by bank transfer, through a payment application, or by any other method outside Petsly, whether before, during, or after a booking. Meet and greets: A meet and greet is an introduction only. Any service discussed or agreed at a meet and greet must be booked and paid for through the platform. Where a fee applies to a meet and greet, it is set and collected through the platform, and neither party may request or accept payment for a meet and greet outside Petsly. Taking, or attempting to take, a booking off the platform is a serious breach of these Terms and may result in the suspension or permanent termination of your account in accordance with Section 17. Tax and VAT: Pet sitters are independent service providers and are solely responsible for complying with all applicable tax laws and regulations, including income tax and VAT registration obligations (in Cyprus, the VAT registration threshold is currently €15,600 in taxable turnover per rolling 12 months). Petsly does not withhold or remit tax on sitters' behalf. Petsly provides sitters with access to their payout history and financial statements through the app, which sitters may use for their own tax reporting. If you are uncertain about your tax obligations, you should seek independent professional tax advice.
6. User Responsibilities
Pet owners must provide accurate information about their pets, including medical conditions, temperament, vaccination status, and special requirements. Pet sitters must provide safe and appropriate care as agreed upon in the booking. All users agree to treat each other with respect and to comply with all applicable laws and regulations.
7. Prohibited Uses
You may not use our service for any illegal purpose or to encourage others to perform illegal acts. You may not violate any local, state, national, or international law or regulation. You may not attempt to circumvent the platform to conduct transactions outside of Petsly. Sharing of contact details: You must not share, request, or attempt to exchange personal contact details — including telephone numbers, email addresses, social media handles, messaging application identifiers, website addresses, or payment application details — through Petsly messages, voice notes, images, profile fields, or booking notes, until either a meet and greet with that user has been scheduled or completed, or a booking with that user has been accepted. Once a meet and greet has been scheduled or completed, or a booking has been accepted, contact details may be exchanged for the purpose of arranging and delivering that service. Deliberately obscuring contact details in order to evade detection — including spelling a number out in words, splitting it across several messages, dictating it in a voice note, or embedding it in an image — is itself a breach of these Terms. Enforcement: Petsly may withhold or block any message that breaches this Section, and may issue warnings, restrict features, and suspend or permanently terminate the account of any user who breaches it, in accordance with Section 17. Repeated attempts to exchange contact details or to arrange payment outside the platform are treated as serious breaches and may result in immediate and permanent termination without prior warning.
8. Intellectual Property
All content, materials, branding, logos, trademarks, software, and technology on the Petsly platform are the exclusive property of Petsly or its licensors and are protected by applicable intellectual property laws. You are expressly prohibited from copying, reproducing, distributing, publishing, displaying, modifying, or creating derivative works of any platform content without Petsly's prior written consent. Any unauthorised use of Petsly's intellectual property may result in account termination and legal action.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Petsly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, pet injury or death, property damage, or other intangible losses arising from your use of the platform or any services booked through it.
10. Indemnity
You agree to indemnify, defend, and hold harmless Petsly and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the platform; (b) your breach of these Terms; (c) your violation of any applicable law; or (d) any dispute between you and another user.
11. Force Majeure
Petsly shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, civil unrest, government actions, system failures, internet outages, third-party service disruptions, or any other event outside Petsly's reasonable control. In such circumstances, Petsly's obligations will be suspended for the duration of the event.
12. Communication Policy
Official communications from Petsly will be delivered via email and/or in-app notifications. It is your responsibility to ensure that your registered email address is accurate and to regularly monitor both your email and in-app notifications. Petsly will not be responsible for any loss or inconvenience arising from a user's failure to receive communications due to incorrect contact details or failure to monitor these channels.
13. Data Protection & GDPR
We process your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and applicable national data protection laws. You have the right to access, rectify, erase, restrict processing, and port your personal data, as well as the right to object to processing. For full details on how we collect, use, and protect your personal data, and how to exercise your rights, please refer to our Privacy Policy.
14. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes through the app or email. Your continued use of the platform after any modifications constitutes your acceptance of the updated terms.
15. Governing Law & Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of the Republic of Cyprus, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Cyprus, unless otherwise required by mandatory consumer protection laws applicable in your country of residence. EU Online Dispute Resolution: If you are an EU consumer and have a complaint that cannot be resolved through our support channels, you may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Our contact email for ODR purposes is support@petsly.pet. Informal resolution: Before initiating formal legal proceedings, you agree to first contact us at support@petsly.pet and allow us 30 days to attempt to resolve the matter informally.
16. Age Requirements
You must be at least 18 years of age to register and use the Petsly platform. By creating an account and proceeding through registration, you represent, warrant, and confirm that you are 18 years of age or older. If you are under 18, you are not permitted to create an account or use the platform. If we discover that a user is under 18, we will immediately terminate the account and delete associated personal data in accordance with our Privacy Policy.
17. Account Suspension and Termination
Petsly reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or harmful activity, or posed a risk to other users or the integrity of the platform. Upon termination, your right to access and use the platform ceases immediately. Pending bookings at the time of termination will be handled in accordance with our cancellation policy. Petsly may also delete your account and associated data subject to applicable data retention obligations.
18. User-Generated Content
By submitting reviews, ratings, profile descriptions, photographs, or any other content to the platform (collectively, User Content), you grant Petsly a non-exclusive, royalty-free, worldwide, sublicensable licence to use, display, reproduce, and distribute such content for the purposes of operating, improving, and promoting the platform. You represent and warrant that your User Content does not infringe any third-party intellectual property rights and does not contain unlawful, offensive, discriminatory, or misleading material. Petsly reserves the right to remove any User Content at its sole discretion without prior notice.
19. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms of Service, together with the Privacy Policy and any additional terms applicable to specific features of the platform, constitute the entire agreement between you and Petsly with respect to your use of the platform and supersede all prior or contemporaneous agreements, representations, warranties, and understandings relating to the same subject matter.
21. Insurance
Platform insurance: Petsly does not provide insurance coverage for bookings made through the platform. Petsly is a marketplace that connects pet owners with independent pet sitters and does not underwrite, arrange, or guarantee any insurance policy in connection with bookings. Sitter insurance: Petsly strongly recommends that pet sitters obtain appropriate professional liability and/or pet care insurance before offering services through the platform. Sitters are solely responsible for maintaining any insurance required by applicable law or deemed prudent for their activities. Pet owner responsibility: Pet owners should verify that their sitter holds appropriate insurance before proceeding with a booking. Petsly does not verify whether any sitter holds insurance and makes no representation regarding any sitter's insurance status. Limitation: In no circumstances shall Petsly be liable for any loss, damage, injury, illness, or death of any pet, person, or property arising from services booked through the platform, whether or not insurance is in place.
22. Communications and Content Moderation
All communication between pet owners and pet sitters must take place through the Petsly in-app messaging system. To protect our users and maintain the integrity and safety of the platform, Petsly may use automated tools and, where appropriate, manual review to screen, filter, monitor, and moderate messages, voice notes, images, and any other media shared through the platform. This includes, without limitation, detecting and blocking abusive, unlawful, sexual, or unsafe content, and preventing the sharing of personal contact details or attempts to arrange or pay for services outside of Petsly (see Section 7). Petsly reserves the right, but assumes no obligation, to review, monitor, withhold, block, or remove any message or content, and to take action against users who violate these Terms, including issuing warnings, restricting features, or suspending or terminating accounts (see Section 17). While Petsly does not monitor every communication and respects your privacy, you acknowledge and agree that messages and content transmitted through the platform are not fully private as against Petsly's automated moderation systems and authorised support and administrative staff, who may access such content where necessary for safety, fraud prevention, dispute resolution, customer support, or legal-compliance purposes, as further described in our Privacy Policy. This right does not create any obligation for Petsly to monitor content, nor any liability for content shared between users. Such automated screening and review may be performed using third-party artificial-intelligence services, and may extend to booking-related notes and other content submitted through the platform, as described in our Privacy Policy.
23. Independent Contractor Status
By registering as a service provider on Petsly, you acknowledge and agree that you do so as an independent, self-employed individual or business, and not as an employee, worker, partner, joint venturer, or agent of Petsly. Nothing in these Terms creates an employment relationship, partnership, or agency between you and Petsly. You retain sole control over whether, when, and for whom you provide services, which bookings you accept or decline, and the prices you set. You are solely responsible for your own tax, social insurance, VAT, licensing, and any other legal or regulatory obligations arising from your activity on the platform, and for any insurance you choose to hold. Petsly does not withhold taxes or contributions on your behalf and provides no employment benefits of any kind.
